Welcome to Canvas Programs! These Terms of Service (“Terms”) govern your use of our website located at www.canvasprograms.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site. 

Any use of this and other affiliated Canvas Programs websites and web services is bound by these Terms, as well as by the laws of Ontario and Canada. 

1. Use of the Site 

1.1 Eligibility: 

The Site is intended for use by individuals of all ages, including youth under the age of 18, in connection with Canvas Programs’ charitable and educational initiatives. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the Site. By using the Site, you confirm that you have such consent, or that you are a parent or legal guardian providing consent on behalf of a minor. 

Canvas Programs does not knowingly collect personal information from users under 18 without appropriate parental or guardian consent. We encourage parents and guardians to monitor the online activities of minors and to guide them in using the internet safely and responsibly.

1.2 License: 

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Site for your personal, non-commercial use, subject to these Terms. 

1.3 Prohibited Activities: 

You agree not to: 

  • Use the Site for any unlawful purpose. 

  • Engage in any activity that could harm, disrupt, or interfere with the functioning of the Site. 

  • Attempt to gain unauthorized access to any portion or feature of the Site. 

  • Use any automated means, such as bots or scrapers, to access the Site. 

2. Intellectual Property 

All content on the Site, including text, graphics, logos, images, and publications are the property of Canvas Programs or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our express written permission. 

3. Permission to Copy 

You may be allowed, without obtaining prior written permission, to use certain images, reports or text for promotion, in books and other printed matter, on clothing or other promotional items, online and Internet locations, for public exhibitions or demonstrations, in software applications, in television programs, commercials, movies, and/or video tapes, provided the use is not disparaging. The use must fall within the definition of “fair dealing” or “fair use” as defined under Canadian, U.S. and other applicable international copyright law. No use should mislead the public as to Canvas Programs sponsorship, affiliation or endorsement of your products or services. Canvas Programs reserves the right to withdraw permission at any time at the organization’s discretion. 

4. Copyright attribution  

Copyright attribution should state: “republished/reposted with permission from for Canvas Programs.” Standard reference citations, hyperlinks, and creative commons licensing reference is required when available. 

5. Disclaimer of Warranties 

The Site is provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, regarding the operation or availability of the Site, or the information, content, or materials included on the Site. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. 

6. Limitation of Liability 

To the fullest extent permitted by applicable law, Canvas Programs and its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: 

  • Your use of or inability to use the Site. 

  • Any unauthorized access to or use of our servers and/or any personal information stored therein. 

  • Any interruption or cessation of transmission to or from the Site. 

  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party. 

  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site. 

5. Indemnification 

You agree to indemnify and hold harmless Canvas Programs and its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms. 

6. Governing Law 

These Terms shall be governed by and construed in accordance with the laws of Ontario and Canada, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within the provincial and/or federal court to resolve any dispute or claim arising from these Terms. 

7. Changes to These Terms 

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.

Privacy Policy

At Canvas Programs we prioritize the privacy of our visitors. This Privacy Policy outlines the types of information that is collected and recorded by Canvas Programs and how we use it. 

1. Collection of Personal Information 

1.1 Information You Provide Us With 

  • Subscriber Details: When you subscribe to our newsletters or express interest in a program, we will obtain your contact details such as your email address and phone number. 

  • Other Information: We collect information when you communicate directly with us by contacting us via the Site or via social media (such as through LinkedIn, Instagram or Facebook, responding to surveys, participating in contests or events, or engaging in a web chat. We may also monitor and record our virtual meetings (webinar, events…etc.) for statistical purposes, internal training, and maintaining a high level of service quality. In these circumstances, we may collect your contact information such as your name, email address, demographic information, social media profile information, and other information you choose to share with us. 

1.2 Information We Collect Automatically 

Like most websites, when you visit our Site, we may receive information about your visit, use, or interaction with our Site. Although most of the information we collect is anonymized and aggregated usage data such as how many individuals visited our Sites, peak hours of visits, the general location of your device, and which page(s) were viewed, we may also collect your Internet Protocol (“IP”) address.  

1.3 Information We Collect From Third Parties 

We collect information from third parties such as from our payment processors or third-party platforms where you may submit information as part of a program. We may collect information about your social media profile when you interact with us on those platforms. 

2. Use of Personal Information 

We use your Personal Information to provide you with communications and operate our Sites. We may use your information to: 

  • Register your attendance at events and webinars that we may host; 

  • Deliver newsletters and reports to you which you have subscribed to; 

  • Deliver services and features on our Sites; 

  • Facilitate and process donations you choose to make; 

  • Process purchases through our Corner Store; 

  • Measure and understand the effectiveness of content on our Sites and Programs so that we can understand where we can have greater impact on the community; 

  • Offer content and/or opportunities that we think will be of interest to you such as causes to support, events to attend, and Programs to participate in; 

  • Respond to your inquiries or requests; 

  • Keep our Sites and Programs secure and safe; and 

  • Comply with our legal or regulatory obligations. 

We will only use your Personal Information for purposes described in this Privacy Policy or for purposes that we informed you of at the time of collecting your information. If we intend to use or disclose your Personal Information for a new purpose, we will ask you for your consent first, unless we are otherwise permitted by law or court order. 

Canvas Programs maintains a mailing list for periodic newsletters. At any time, you may choose to discontinue receiving communications from us. To request that Canvas Programs remove you from our mailing list, please contact us at info@canvasprograms.com. In addition, all mailing list email messages sent by Canvas Programs will include an unsubscribe link allowing recipients to discontinue receiving non-transactional communications from us, in accordance with Canadian Anti-Spam Legislation (CASL) requirements. 

3. Public and Private Forums 

Please remember that any information that is disclosed on forums, such as those hosted by Canvas Programs, or public third party social media platforms, are at the users risk. You should exercise caution when deciding to disclose your personal information. We cannot guarantee the security of any information you disclose online, and you disclose such information at your own risk. 

4. Sharing of Personal Information 

We may disclose your Personal Information under certain limited circumstances. These circumstances include: 

  • Service Providers, in order to deliver the Programs and the Sites to you. These providers offer solutions for hosting, email, marketing, payment processing, and other business critical operations. They are contractually required to comply with our privacy requirements and standards, ensuring that your Personal Information is protected and remains confidential. 

  • Donation Recognition is shared when you opt to have your name recognized. We may also share your information in order to administer your donation with a secure third-party payment processor. We do not retain your credit card information outside of our payment processors. 

  • Research and advocacy institutions. We may use de-identified and aggregated information for research and advocacy purposes. This information, whether used alone or in combination with other information, cannot identify you. In the event the disclosure of Personal Information would be relevant, we will always seek your explicit consent to disclose such information to certain institutions and we will provide you with information about these institutions before you participate in the polls. 

  • Funder reporting. Canvas Programs aggregates anonymous information about our visitors, such as IP addresses, in order to generate research datasets and populate funder report requirements. Individuals are not identified in the anonymized, aggregated datasets. 

  • Authorities such as law enforcement or competent courts, when it is necessary, or we are compelled to do so. This may include instances where there is a serious risk of harm to you or others, and/or where we have to take legal action to protect our or third-party rights. 

We will not sell or rent your Personal Information. Furthermore, our contracts with service providers dictate that they may not use your information for their own benefit or for any services other than those requested by us. 

5. Cookies and Analytics 

Cookies are small files that a website or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the website’s or service provider’s systems to recognize your browser and capture and remember certain information. 

We use cookies to: 

  • Understand and save user’s preferences for future visits. 

  • Compile aggregate data about site traffic and site interactions in order to offer better site experiences and tools in the future. 

Some cookies and similar technologies help us understand how our visitors engage with our Sites. We make use of Google Analytics, which uses a set of cookies to report site usage statistics without personally identifying individual visitors. 

You can choose to disable cookies through your individual browser options. More detailed information about cookie management with specific web browsers can be found at the browsers’ respective websites. It is important to note that disabling cookies may affect your experience with our Sites, as well as our Sites’ functionality. 

6. Third Party Conduct 

Our Sites contain links to other third-party owned and operated websites. When you follow or click on these links, you are visiting a website that is not owned or operated by Canvas Programs. As such, those websites will have a different privacy policy to Canvas Programs. Canvas Programs is not responsible for the privacy practices of those websites and operators, and encourages you to read the respective privacy policies and notices of these third-party websites to familiarize yourself with their practices. 

7. Information Security 

We have technical, organizational, and physical safeguards appropriate to the sensitivity of your Personal Information. These include safeguards such as ensuring our staff sign confidentiality agreements, limiting access to our facilities, and granting access to information based on a need-to-know basis. We review and update our safeguards regularly to ensure your Personal Information is protected. 

It is important to note that no computer system or online communication is perfectly secure.  We encourage you to take appropriate steps to protect your information, including not sharing more information with us than is necessary. 

8. Data Retention 

Your Personal Information will be kept for at least as long as it is necessary to carry out the purposes set out in this Privacy Notice and subject to applicable laws. We may retain anonymized and aggregated information without time limits to the extent that we have a legitimate and lawful interest in doing so. 

9. Your Rights and Choices 

You may request to view, update, or delete your personal information maintained by Canvas Programs. You may also opt not to receive further communications from Canvas Programs. The procedures for doing so are described below. 

  • Request a Copy: At any time, you may ask for a copy of your personal information previously provided to Canvas Programs To request a copy of your personal information, please contact us at info@canvasprograms.com 

  • Correction: You may change or modify any personal information previously provided to Canvas Programs. To request that your personal information be updated or modified, please contact us at info@canvasprograms.com

  • Deletion: At any time, you may request that we delete from our database any personal information previously provided to Canvas Programs. To make a personal information deletion request, please contact us at info@ocanvasprograms.com 

Please allow up to 30 days for us to respond to requests for access/copies, requests for corrections, or requests for deletion. If we need more time to fulfill your request, we will let you know. As required by law, we will validate your identity prior to fulfilling any requests. Please be aware that while we will endeavor to fulfill any requests received, there may be circumstances and exceptions that exist in applicable law that prevent us from fulfilling requests.

Accessibility Policy

Canvas Programs will make every reasonable effort to meet the requirements of the Accessibility for Ontarians with Disabilities Act (AODA), 2005, including all applicable elements of the Integrated Accessibility Standards. 

Information and Communication 

Canvas Programs will make its information accessible to people with disabilities by creating materials and supports in accessible formats, and it will notify the public of the types of accessible formats provided. For a detailed description of each principle and format, please visit www.AccessOn.ca. 

Canvas Programs will provide automated captioning in English for video content produced by the organization. 

Further, Canvas Programs will deliver alternate formats of information to clients, upon request. If a particular material cannot be converted into an accessible format that meets the needs of the person requesting it, Canvas Programs will collaborate with the individual and provide a summary of the information or communication in another way that is suitable to the person requesting it. 

Canadian Accessibility Standards and Regulations 

Ontario’s Integrated Accessibility Standards Regulation (IASR) aims to make Ontario more accessible to people with disabilities. The Accessibility for Ontarians with Disabilities Act (AODA), 2005 is the foundation on which the IASR is built. The AODA allows for enforcement of the IASR through inspections, compliance orders, and administrative penalties. 

Public-Facing Services 

Canvas Programs will provide customer service in a manner that removes barriers for people with disabilities according to the following key principles of the AODA:  

Services will be provided in a manner that respects the dignity and independence of persons with disabilities.  

Service to people with disabilities will be integrated with others, unless an alternate way of providing the goods, service or facility is required by the person with the disability.  

Persons with disabilities will be given equal opportunity to use and benefit from the goods, services, or facilities an organization or business has to offer.   

We will communicate with people with disabilities in a way that takes the individual’s disability into account.  

Assistive Devices, and Service Animals, Service Dogs or Guide Dogs 

Persons with disabilities who use an assistive device will be permitted to use their own device to access the services provided by Canvas Programs. 

Support Workers 

If a person with a disability is accompanied by a support person, Canvas Programs will ensure that both persons are permitted to enter the premises together and that the person with a disability is not prevented from having access to the support person while on the premises. In remote settings, support workers are welcome to support an individual with disabilities. 

Service Interruptions 

If there is a temporary disruption in any of our services either in whole or in part, Canvas Programs will provide notice of the disruption to the public via as many channels as possible, in accessible formats, where available. We will physically post notices where the disruption is taking place as well as through any other channels that are appropriate such as email, phone, text, social media, or on our website. 

Notice of the disruption will include the reason for the disruption, its anticipated duration and a description of alternative facilities or services, if any, that are available.  

Process for Receiving Feedback 

Canvas Programs will accept feedback about the way in which it provides goods and services to persons with disabilities in person, by phone or email (info@canvasprograms.com), or in another way that is suitable to a person with a disability.  

When a complaint is received about the way we provide goods, services, or facilities to persons with disabilities, Canvas Programs will let the person who submitted the feedback know about the actions the organization will take to resolve the issue.  

Transportation 

Canvas Programs does not provide conventional or specialized commercial transportation services to passengers and is not required to adhere to the Transportation Standard.  

In-Person Events 

If Canvas Programs hosts events in person, it will endeavour to utilize spaces that adhere to the Design of Public Spaces Standard of the AODA. Canvas Programs will take the potential accessibility needs of employees and attendees into account when planning and hosting in-person events.
